The Legal Document Suite

These documents must be signed while you still have legal capacity. Waiting until after a nursing home admission can eliminate the opportunity to establish them.

Living will: Documents your wishes regarding life-sustaining medical treatment during periods of incapacitation, so your care preferences are followed even if you can’t speak for yourself.
Healthcare power of attorney: Designates a trusted person to make medical decisions on your behalf when you can’t make them independently.

Planning Ahead vs. Responding to a Crisis

A long-term care plan built while you still have full legal capacity gives you far more options than one assembled under pressure. Ohio Medicaid’s 60-month look-back period means that asset transfers made within five years of a nursing home application are reviewed for potential penalty, so starting earlier can open up more strategies. Two planning tools that are often underused are VA Aid and Attendance benefits and long-term care insurance. Both can help reduce the financial burden of extended care when they apply.

VA Aid & Attendance
This pension benefit is available to wartime veterans and surviving spouses who require assistance with daily living activities and meet income and asset eligibility requirements. It can help cover the costs of in-home care, assisted living, or nursing home placement for those who qualify. We assist eligible veterans and their families with pursuing this benefit as part of the overall long-term care plan.

Long-Term Care Insurance
Policies can cover nursing home, assisted living, and in-home care costs, but eligibility and premiums depend heavily on age and health status at the time of application. Applying before health issues arise can produce broader coverage options and lower premiums. We help clients evaluate policies so they understand what coverage they’re getting and how it fits their broader plan.
