Should You Take The Breathalyzer?

Last week a client called me at 2:30 AM asking if his friend should take the breathalyzer. Nearly always in Ohio the answer is “yes.” Failure to take the breathalyzer can result in a one year license suspension. The policeman can testify about the poor driving, bloodshot eyes, slurred speech, odor of alcohol, and failure to pass the sobriety tests, so a prosecution is quite likely even if there’s no test result. If you or a friend get a DUI, then call us right away.

Review Your Will.

Have you forgotten the name of your alternate executor? Did you name a guardian for your children, but they are now older than 21? Do you have new children or grandchildren? Is your will more than 10 years old? If you answered “yes,” then you need to review your will. We send our clients a reminder to do this every 2 to 4 years. Call us to schedule your appointment.

What If I Cause An Accident?

Do not admit it is your fault. Anything you say can and will be used against you. Provide your license and insurance information. Be polite and helpful. But do not state that you caused the accident. Call your insurer immediately and let them handle it.

What If I’m An Accident Victim?

Immediately seek treatment if you have any discomfort, then call us. The pain usually gets worse after the first day. The longer the delay in seeking treatment, then the greater the skepticism by the adjustor. Go to the ER, or see your family doctor, or go to an after hours clinic. Call us after you see a doctor. Let us deal with the insurance company. They may try to get you to make damaging admissions or pressure you to settle for less than the claim is worth.

Where Is Your Living Will?

A living will permits the removal of life support if one’s condition is hopeless. Do you have one? Does your spouse, or child, or parent, know where yours is? Tell them now! If you do not have one, then call us today so we can draft one for you.

Collecting Bills.

Should you sue someone who owes you money? The first issue is whether they are collectible. A million dollar judgment does no good if the debtor has nothing. A good place to start is learning if the person owns or rents his home. We can tell you how to find out.
